Decision imminent in NSW nurses and midwives pay dispute

A long-running pay dispute involving public sector nurses and midwives in New South Wales is set to reach a turning point, with the NSW Industrial Relations Commission expected to deliver its decision on Thursday.

The case, brought forward by the NSW Nurses and Midwives’ Association, has been under consideration for four months following a six week hearing that ran from September to November last year. During that period, dozens of nurses, midwives and expert witnesses gave evidence on pay, working conditions and the evolving demands of the professions.

The outcome is being closely watched across the health sector, particularly after a year marked by widespread industrial action. Tens of thousands of nurses and midwives took part in strikes throughout 2024, calling for higher pay and improved staffing conditions. The campaign drew attention to concerns about workload pressures, retention challenges and the broader impact on patient care.

At the centre of the case is an argument that nursing and midwifery roles have been historically undervalued, particularly given their gender composition and the complexity of modern healthcare. The union has also pointed to the effect of past wage policies, including caps introduced by previous governments, alongside rising living costs that have added financial strain for workers.

Supporters of the claim argue that pay levels have not kept pace with the responsibilities placed on nurses and midwives, especially as care delivery has changed over the past decade and a half. They say the decision presents an opportunity to reassess how these roles are recognised within the public sector.

Government representatives have previously indicated the need to balance any wage adjustments with broader budget considerations, noting the potential impact on public finances and flow-on effects across other sectors. The case has therefore been viewed as a test of how industrial tribunals approach claims linked to gender-based pay disparities.

The decision will be delivered publicly, with a livestream scheduled through the commission’s official channels. Union leaders and members are expected to respond shortly afterwards outside the commission’s Sydney offices.

Whatever the outcome, it is likely to influence future negotiations across the healthcare system and may set a reference point for similar claims in other parts of the country.
